Home Gift Tax Relief After 65
Under current Spanish tax rules, people over 65 may be exempt from personal income tax (IRPF) on the gain when gifting their main home. Spain's Tax Agency confirms that this relief can apply to both sales and gifts. It is an existing exemption, not a new tax-free benefit for every property. The property must qualify as the donor's habitual residence, generally requiring at least three years of continuous residence. If the owner has moved out, timing and legal exceptions must be checked. The exemption may also apply when gifting bare ownership while retaining lifetime usufruct. Other taxes remain relevant. The recipient must deal with Spanish gift tax and may owe municipal land-value tax. In the Valencian Community, qualifying gifts between close relatives benefit from a 99% reduction in gift-tax liability, subject to legal conditions. Property gifts require a notarial deed. Different income-tax rules apply to non-resident donors. Before signing, check the property's use, tax position and potential inheritance consequences. Adel Properties' Advice section provides multilingual tax and legal guidance. General information as of 29 October 2026; rules may change, so consult a qualified adviser.
